CE AS PRODUCER

Software used in machinery and other mechanical equipment is considered an integral part of the machine and is covered by the Machinery Directive and therefore does not require independent CE marking.

However, the CE marking is required for stand-alone software products whose application serves a medical purpose.

According to Directive 93/42/EEC, a medical device with the CE marking meets all European legal requirements. The software embedded in the device should also comply with EU standards. For example, if an MRI scanner needs to be tested to obtain CE certification as a medical device, the software embedded in the scanner should also be tested.

The Computer Program Directive 2009/24/EC of the European Union regulates the legal protection of computer programs under the copyright of the European Union.

The experts at easyCE will be happy to help you place your products on the market and assess special cases. We are happy to support you with CE, UKCA and other labelling.

FAQ

When is software to be classified as medical devices and subject to CE marking?

The MDR (Medical Device Regulation) qualifies software as follows:

What steps must be taken in the conformity assessment process for medical software?

Medical software goes through exactly the same process as other devices/medical devices to obtain CE marking before it is sold in the EU. The following phases are part of the CE marking process:

How is medical software classified under the Medical Devices Directive?

The MDR provides for classification rule II for software, which defines software for medical purposes as follows:

Which software products should NOT be regarded as medical software and therefore must not bear the CE mark?

The following software examples are not medical devices:

Is the qualification of medical software subject to CE marking always clear?

However, it can sometimes be difficult to qualify software as a medical device. Borderline cases usually exist with standalone software, such as software, which could be used simultaneously for general wellness purposes or for treatment purposes. In this case, the qualification as a medical device results from the demands on the intended purpose.

What is the procedure for obtaining the CE marking for medical software?

The procedure for obtaining the CE marking depends on the risk class of a medical device:

What are the requirements for the user manual or manual of medical software?

Each medical device should be accompanied by instructions for use, unless the device could be considered as belonging to risk class I or IIa and could be used safely without such guidance. Directive 93/42/EEC clearly defines which items should be included in the instructions for use, such as safety instructions. Maintenance information should also be part of a user manual.

How are medical software bug fixes and enhancements handled from a CE marking perspective?

Annex XI deals with production, and software production consists of installation, configuration and testing:

What harmonised standards can be applied to medical software?

Applying the following standards is the best thing to do before any project on CE conformity of medical device software.

Does the conformity assessment for medical software have to be carried out again with each update/upgrade?

Software is updated very frequently, with important changes to existing features or even new features. When software is updated annually with significant changes (which is often the case with standalone software),

What do manufacturers have to do to obtain the CE declaration of conformity for medical software and to apply the CE mark?

If the documentation clearly follows a software development process that conforms to the standards cited above, a notified body will issue a certificate of conformity depending on the class of device. The manufacturer then declares conformity.

CE marking for electrical equipment in medical laboratories

CE marking for electrical equipment in medical laboratories

As part of the ISO 45001 certification preparation process, easyCE supported a manufacturer of electrical laboratory equipment in the correct classification and CE conformity of its products. Our experts carried out a precise analysis to distinguish between medical devices and electrical equipment in order to ensure correct classification in terms of occupational health and safety. This clarity was crucial for the ISO 45001 requirements regarding hazard identification and risk assessment in the workplace. Successful documentation and conformity assessment enabled the customer to operate its laboratory equipment in full compliance with occupational health and safety guidelines and to pass the ISO audit without any objections.

Takes into account, among others: EN 55032, EN 55035, EN 60335-1 etc.

CE marking for test station for low-pressure units

CE marking for test station for low-pressure units

In the run-up to an ISO 45001 occupational health and safety audit, easyCE supported an industrial company in compiling CE documentation for an internal test bench for low-pressure units in accordance with occupational health and safety regulations. Our experts first analyzed the regulatory classification of the test bench and were able to prove through precise measurements that the Pressure Equipment Directive was not applicable. This clarification was crucial for the correct risk assessment within the framework of the ISO 45001 management system. The CE documentation subsequently created took particular account of occupational health and safety aspects such as operational safety and emergency procedures. This enabled the customer not only to demonstrate CE conformity, but also to pass its ISO 45001 certification without any deviations in the area of work equipment.

Takes into account, among others: 2006/42/EG, EN ISO 12100, EN 60204-1, EN ISO 4414, EN ISO 13849-1 etc.
